the lady is the real gem

na strīratnasamaṁ ratnam||
313|| cānakyasūtraṁ||

The great aphorism of Guru Chanakya.. in his monumental string of great sayings... Chanakya Niti.

Meaning

There is no gem that would be equal to a lady ( in the house)

It would seem a very ordinary statement.. Even a flattering statement made by a man to please the womenfolk

But Chanakya was a no-nonsense person.. and a sage and celibate and a great intellectual..  he had nothing to gain in his life through flattery..

But he was very wise, wisdom personified..

The most valuable possession in material wealth was stored as gold and precious gems.. And the gems are most valuable when they are blemish-less.

The family, society, the nation.. all are held in its proper workable shape only by the presence of females.. There can be no dispute about it..
We in India, assigned feminine gender to all the soft and finer things.. the earth is given feminine gender.. Most of the rivers are feminine.. The flower creepers and herbs are usually feminine..
Many things which are matter of fact can become workable only when there is the touch of affection by a woman.. The woman may be a grandmother, mother wife, sister, daughter or granddaughter..
And even when the male created divine forms were assigned supreme power, the same forms were shackled with the riddle that these forms would be of no effect when they were in the presence of their female counterparts.. Shiva without Shakti or Uma is a nobody.. Narayana without Lakshmi or Shree, Brahmadeva without Vani.. are of not use to anyone including themselves..

Only the feminine touch can hold together the delicate human relationships .. the relationships which form a tight rope walk between goodwill and generosity on the one side and crass selfishness on the other end..

Pranams to all Mothers.. and all ladies who are the embodiment of the Divine mother..

crime and punishment

aparādhānurūpo daṇḍaḥ||328
cāṇakyasūtre||

A crisp and seemingly obvious statement found and the 328th aphorism of Chanakya.. Lots and lots of Law, justice, and commonsense concentrated in two or three words
============
The rule means
Punishment should be commensurate with the offence committed..
============
The master implies that punishment is the most effective deterrent and also the keeper of social order.. but that the dynamics of legal process is always varying and issue specific.. Lesser punishment can make the victim confident and would make him commit more offences.. Punishment on an excessive scale can defeat the purpose of law and justice altogether..

daṇḍaḥ śāsti prajāḥ sarvāḥ daṇḍa evābhirakṣati|
daṇḍaḥ supteṣu jāgarti daṇḍaṁ dharmaṁ vidurbudhāḥ||
manusmṛtyām||
=============
It is said in Manusmriti
The subjects are kept in discipline and order through the laws of punishment in place.. such laws alone protect people and maintain order in the State... The laws (of punishment) keep awake while everything else sleeps.. and therefore the wise and just consider the laws of punishment as the ideal virtue..
==============
adaṇḍyān daṇḍayan rājā daṇḍyāṁścaivāpyadaṇḍayan|
ayaśo mahadāpnoti narakñcādigacchati||
============
A king who metes out punishment to those who did not deserve punishment, and fails to punish those who deseve to be punished, would incur infamy and ultimately reach hell too.
==============
vadho'rthagrahaṇaṁ caiva parikleśastathaiva ca|
iti daṇḍavidhanajñairdaṇḍo'pi trividhaḥ smṛtaḥ||

There are in general three types of punishments, varying in their intensity ..
===============
Capital punishment, or death sentence
Fine, penalty or confiscation of all the wealth owned.
Physical punishment, of varying levels..
This is how the modes of punishment are broadly classified by those who are learned in law..
=============
Of course, statements like that of Master Chanakya have presented the sum and substance of judicial process that prevailed in India millenniums ago.
But when we find that even the most modern thinkers and jurists, after going through so much of material and after evaluating so much of precedence all over the so called civilized society just are forced to nod their heads in approval and marvel at the age old wisdom of the ancients .. we should feel reasonably humble.
.And excessively proud of our past.. perhaps..
That is all..

learn by experience....

learn by experience....

cāṇākyasūtraṁ 543
_________
Even if one is well read and even learned in Science and scriptures, if he does not know the ways of the world he is just equal to a fool, idiot and ignoramus..

So says the master Guru Chanakya..

Yes, we can learn the principles and theories of science, statecraft or for that matter almost anything through books and records..
But such learning has inherent limitations..
The basic principles as studied from books may be very correct.. But they have meaning and relevance only if they are applied for the benefit of all..
Such knowledge can be applied only if we know and understand the nature and mindset of the people..
The people and the environment could be understood only through interaction and observation.
Theoretical and academic knowledge cannot help us in this matter..

The attitudes and mindsets of the people are shaped on the history, geography, economics and sociology of ther respective target groups.. And no textbook can ever supply correct and complete data on this..

So if we are presuming that we are just perfect in our knowledge by going through many standard texts and famous books, we are almost equal to idiots.

One cannot learnn swimming by reading a book, for example..

_____________
It would be nice to recall the following subhashitam too..
It is a quote from Udyogaparvam of Mahabharatam..

ācāryāt pādamādatte pādaṁ śiṣyaḥ svamedhayā|
pādaṁ sabrahmacāribhyaḥ pādaṁ kālakrameṇa ca||

The student receives one fourth of his education from his preceptors..
one fourth from ones own perception, by application of mind and brain
one fourth from living in the company of fellow scholars and by comparison of mutual experience..
And the final quarter can be gained only through the efflux of time.. that is by living and experiencing..

The false witness and the silent witness

The false witness and the silent witness

na syāt kūṭasākṣī||550||
|hāṇakyasūtre||

The great Statesman and lawgiver, Chanakya in his Sootram or aphorism 550, declares that

one should never give false evidence… |

That is, one should never declare as right and genuine something which he has not seen or felt or witnessed to be true and correct.. Moreover, one should never depose depose as genuine anything which he know s is not genuine, before any authority or forum .
---------------------------------------------------------------------------------

On this issue, Sage Yaajnavalkya in his smritis goes a step further..

na dadāti hi yaḥ sākṣyaṁ jānannapi narādhamaḥ|
sa kūṭasākṣiṇām pāpaiḥ tulyo daṇḍena caiva hi||
||yājñavalkyasmṛtau||
A person who declines or refrains from giving evidence before a forum, even while knowing the facts of an issue, is a mean human being equal to a false witness. He should suffer the same sins as a false witness and the state should also mete out identical punishmes to him as if he were a perjurer or a false witness.

---------------------------------------------------------------------------------------------------------------
Mahabharatham ( Bhagavan Vyaasa) goes one more step further.

yaśca kāryārthatattvajño jānannapi na bhāṣate|
so'pi tenaiva pāpena lipyate nātra samśayaḥ||
|ṁahābhārate||

One who is aware of the facts of a case, and is also well versed in law and customs, and simply keeps quiet or declines to intervene with the correct facts and law when it comes for consideration in the appropriate forum, also becomes tarnished and he too partakes in sins to the same extent as the perpetrators of the sinful action..

Babus and Dakoos or Dakoos and Babus?

Babus and Dakoos or Dakoos and Babus?

|chāṇakyasūtrād||

A very realistic finding by the most shewd political scientist, philosopher and administrator.. He has written the Sootras as rules to be followed by an efficient head of a state or a king..

The king should diligently protect the wealth of the state from thieves and the servants of the government too..

One can understand that thieves and burglars operate in divesting the state and the subjects of their hard earned money and wealth.. it is crime in the eyes of the people and the king and it is the profession of the thief.. The king is expected to protect the wealth from such burglars, and also should put down the criminals with a heavy hand..

Okay, the statesman did not stop there..
He is aware that those people who have landed up in the service of the State or the King, have great desire and greater cunning to appropriate for themselves whatever wealth they could handle and dispose of as representatives or operatives of the state or the employees of the king..

Chanakya expects that the authority in power should deal with his own employees with the same alacrity that he would apply while dealing with thieves and burglars..

Perhaps, babus and dakus were practically same in the opinions of Chanakya..

But, the realism being exuded by the sage is eminently logical..
He knew that the thieves required a lot of care and caution to loot..
But usually the state funds are open for the functionaries and employees of the government for misappropriation if the Ruler is not diligent.

Chanakya must have been the one who would have ordered setting up of a Vigilance directorate and a Vigilance commission..
